Presented by Jonathan E. Retsky Litigation & Counseling at Howrey LLP
Presentation Date: June 26th, 2008 at 11:30AM EST.
Summary: Ten years ago, the Court of Appeals for the Federal Circuit opened the door to patenting pure methods not linked to a computer or other machine, so-called "business method patents." In a test case patent application that attempts to patent an investment scheme to be used in hedge funds, the court has decided to reexamine the appropriateness of business method patents. The court is again grappling with the legality of these patents, and if legal, how to recognize, define and examine them. This webinar will explore the legal scheme behind these patents, how the multitude of friend of the court briefs submitted by interested companies and organizations have sided on this issue, and predict a possible outcome.

Second February Webinar: Tax Planning for Improved ROI on R&D Presented by: Trina L. Oettinger & Sang Kim
Presentation Date: February 26th, 2008 at 11:30AM EST. Intellectual property professionals need to be talking with their corporate tax advisors about planned US Internal Revenue Service (IRS) regulations which are expected in second quarter, 2008. Any company with significant overseas sales can dramatically increase its profits through IP management and structuring of its operations to take advantage of tax treaties. Such planning will provide a greater return on R&D investment and enhance cash flow. The pending IRS changes will likely make these structures more difficult and costly.
This Webinar will focus on IP migration structures that permit companies to monetize their IP by shifting income to a low-taxed jurisdiction and thereby significantly lowering the company's effective tax rate

January Webinar: IP Driven M&A: A New Corporate Spin-out Model for Stranded Technology and IP
Presented by: Ron Laurie, with assistance from Joe Pellegrini

Over time, these corporate assets will likely diminish in value as the human capital dissipates, the recorded know-how becomes undecipherable and the patent position stagnates or declines. Ron Laurie will discuss a new approach and provide a case example of how a “Technology Asset Cultivation and Licensing” (TACL) company can be used to significantly enhance value.
